"Kennedy Tapes: 'Government Improvised in the Air'" determines it's copyrighted to the Dallas Morning News, 1963. The Dallas Morning News identifies the photographer as Tom Dillard, part of the Tom Dillard JFK collection.

Fair Use for John F. Kennedy assassination

Though the picture is originally copyright, I, TransUtopian, believe it is covered by the U.S. fair use laws because:

  1. It is a copy of a photograph released by the Dallas Morning News for dissemination in accompaniment of a major news story;
  2. It is one of the most widely disseminated and reproduced photographs of a news event in US and global history;
  3. No free or public domain images have been located for this purpose; and
  4. Reproduction of the image is not believed to limit the copyright owners' rights in any way.
